Agreement to Terms

By accessing our website or using the Ava care-companion service by phone or text message, you agree to these Terms of Service ("Terms") and any additional terms referenced here. If you do not agree, do not use the service. These Terms are an agreement between you and Copilot Health Inc ("Copilot Health", "we", "us"), a company with its principal office at 211 N 14th St., #216, Lincoln, NE 68508-1616.

The Service

Copilot Health provides Ava, a care companion that patients enrolled in a Copilot Health care program can reach by phone call or text message. Ava can receive messages and photos, share them with your care team, answer questions about your program setup, and arrange follow-up from your care team.

Ava is not a substitute for professional medical advice, diagnosis, or treatment, and is not for emergencies. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.

Text Messaging Terms

If you enroll and consent to text messaging, Copilot Health will send SMS messages to the mobile number you provide. These include care-companion replies, follow-ups about photos or requests you send, and account or setup notifications.

1. Message frequency varies. Message and data rates may apply.
2. Reply STOP to any message to opt out. Reply START to resubscribe.
3. Reply HELP for help, visit https://copilothealth.com, or email support@copilothealth.com.
4. Consent to receive text messages is not a condition of receiving care or of purchasing any product or service.
5. Wireless carriers are not liable for delayed or undelivered messages.
6. Our collection and use of your phone number is described in our Privacy Policy. We do not sell or share your mobile number or opt-in consent with third parties for their marketing purposes.

Eligibility and Your Responsibilities

You must be at least 18 years old, or use the service with the involvement of a parent or guardian, and you must be the subscriber or customary user of the mobile number you enroll. You agree to notify us promptly if you change or give up that number. You agree to provide accurate information and to use the service only for its intended care-support purposes.

Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Copilot Health and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Disclaimers and Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Copilot Health will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law.

Termination

We may suspend or end your access to the service at any time, including if you violate these Terms. You may stop using the service at any time; reply STOP to end text messaging.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date. Continued use of the service after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Nebraska and the applicable laws of the United States, without regard to conflict-of-law rules. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Nebraska, and you consent to personal jurisdiction in those courts.
